Once the province of the rich and famous, written agreements entered into before marriage are now proving of interest to more people seeking to avoid the trauma and cost of arguing if things unfortunately go wrong in the future.

Such written agreements are not binding under English Law, but the existence of such an agreement is a circumstance which the Court will bear in mind when considering an appropriate financial outcome on divorce. An agreement will only have any value if each person receives independent legal advice and provides full and frank financial disclosure before entering into the agreement.
